Terms of Service — Carpooling
Version: 0.2 — DRAFT — PLACEHOLDERS TO REPLACE Date: 25 August 2026 Effective date: 31 December 2099
1. Operator
Carpooling is operated by [[DRAFT: DENOMINAZIONE LEGALE]], [[DRAFT: SEDE LEGALE COMPLETA]], [[DRAFT: CODICE FISCALE]] / [[DRAFT: PARTITA IVA]], support@placeholder.invalid, [[DRAFT: PEC O NON APPLICABILE]].
The Service enables users to organise shared car journeys, create or join groups, coordinate trips, communicate and keep track of amounts to be settled directly between participants.
2. Nature of the Service
The Operator provides a platform for users to meet and organise carpooling. It is not a carrier, taxi/NCC service, driver, passenger, employer or insurer, is not a party to transport arrangements between users, does not guarantee that a trip will occur, and does not hold or transfer money between users.
Users independently decide whether to travel together and remain responsible for their conduct and legal compliance.
3. Age
The Service is for users aged 18 or over.
4. Account
Users must provide the information required for registration, keep it accurate and protect their account. Accounts are personal and may not be transferred. Fraudulent, abusive or unlawful use may result in restriction or suspension.
5. Profile information
Users may provide profile, travel-preference, interest, availability and vehicle information. Such information must be accurate and must not infringe third-party rights.
6. Search, suggestions and compatibility
The Service may suggest users, groups or travel opportunities based on compatibility factors such as route, availability, times and user preferences.
Suggestions are organisational only and do not guarantee personal compatibility, reliability, safety, punctuality or trip completion. Final decisions remain with the users involved.
7. Groups
The Service may support groups with different access settings and administrative roles. Group administrators must use their functions lawfully and consistently with these Terms.
8. Invitations
Users may invite others through channels available on their device. Invitations must not be used for spam or unwanted communications. External services are governed by their own terms and privacy policies.
9. Drivers and vehicles
Drivers must hold a valid licence, be legally entitled to use the vehicle, maintain mandatory insurance, use a legally compliant and roadworthy vehicle, comply with road-safety rules and respect passenger capacity.
The Service must not be used to carry on unauthorised professional passenger transport.
10. Routes and meeting points
Route, traffic, transit, distance and meeting-point information may rely on third-party data and may be inaccurate or outdated. Users must independently check that meeting points are safe and lawful.
Do not use the Service in a way that distracts the driver.
11. Trip organisation
Availability, driver assignment, substitutions, changes and cancellations are organisational records and do not guarantee that a trip will occur.
12. Cost sharing
The Service may display estimated contributions and record bilateral credits, debts or settlement status between users.
These records are organisational only. The Operator does not receive, hold or transfer money, certify external payments or collect debts. Users settle any amounts directly outside the Service.
The Service is intended for cost-sharing carpooling, not unauthorised commercial passenger transport.
13. Messages and user content
Users may exchange messages, photos and other content. Users retain their rights and grant the Operator the limited rights necessary to host, transmit, display, protect and moderate that content to operate the Service.
Users must have the rights needed for uploaded content and must not post unlawful content.
14. Prohibited conduct
No threats, unlawful harassment or discrimination, impersonation, fraud, unlawful disclosure of personal data, illegal content, spam, unauthorised access, security circumvention or unlawful activity.
The Community, Safety & Moderation Rules also apply.
15. Reports and moderation
Users may block and report users, groups or content. The Operator may take proportionate measures including content restriction/removal, feature limitation or account/group suspension or closure.
16. Notifications
Operational and safety communications are separate from promotional communications. Marketing is sent only when legally permitted and, where required, with consent.
17. Third-party services
Some functions depend on external services. Their uninterrupted availability cannot be guaranteed. External services are also governed by their own terms.
18. Availability and updates
The Service may be updated for security, compliance, compatibility or improvement. A minimum app version may be required. Uninterrupted availability is not guaranteed.
19. Intellectual property
Software, marks, graphics, editorial content and other Operator/licensor materials remain owned by their respective rightsholders.
20. Account closure
Users may request account deletion through available Service functions. Pending group ownership, disputes or balances may need to be addressed first. Data handling after closure is described in the Privacy Policy.
21. Liability
The Operator does not guarantee user identity, reliability, conduct or suitability beyond checks expressly stated in the Service. Each user is responsible for deciding whether to travel with others.
Nothing limits mandatory consumer rights or liability that cannot lawfully be excluded.
22. Changes
Material changes to these Terms will be communicated appropriately and, where necessary, users may be asked to accept the updated version.
23. Law and disputes
Italian law applies, without prejudice to mandatory consumer protections. Mandatory consumer forum rules remain unaffected. Contact legal@placeholder.invalid.
